Return of goods

  • You have 14 days to return the goods.
  • The goods must be in their original packaging with the original invoice and all markings.
  • The goods must not have been used.
  • Section 56(11) of the Law of Obligations Act provides that in the case of a contract which is the subject of a delivery of goods, the period for withdrawal only starts to run from the moment the consumer receives the goods.
These provisions regulate when the right of withdrawal expires, i.e. how to calculate the day on which the right expires. This is 14 days from the date of receipt of the goods. The right of withdrawal is subject to the conclusion of the transaction and, once concluded, the right of withdrawal is also subject to the statutory time limit. A contrary interpretation would be contrary to the rights of traders, as it would be unreasonable for the trader to incur the expense of bundling and sending the goods in a situation where the consumer does not want them anyway and returns them.
  • The money for the returned goods shall be credited to the Buyer’s bank account as soon as possible, but not later than 7 working days after the goods are returned to the Seller.
  • The shipping costs of the goods are non-refundable (if there is a shipping charge for the order, the Buyer will be responsible for this, as well as the costs of returning the goods).
  • If the goods to be returned have deteriorated, the Buyer must compensate the loss in value.

After what period of time can the seller refuse to take back the product?

Based on the principle of reasonableness set out in Section 7 of the LOA, what is considered reasonable is what persons acting in good faith in the same situation would normally consider reasonable. The Office of Consumer Protection and Technical Supervision has clarified that the consumer has the right to lodge a complaint with the trader within a reasonable period of time from the purchase, but that the consumer must contact the trader without delay. In the case of a product whose characteristics change over time, the reasonable time limit should be shorter than 2 months. Pursuant to Article 24(7) of the Consumer Protection Act, the reasons for rejecting a consumer’s claim shall be given in writing or in a form which can be reproduced in writing. If two months have elapsed and the purchaser has not sent the product for inspection, the purchaser shall be given a written reply stating the reasons for refusing to take back the product.

Return of goods if the Buyer has not taken the parcel out of the machine

If a parcel is lost in a parcel machine or during the provision of a courier service, for example as a result of a technical fault, the service provider is responsible. However, it may also be the case where the consumer has made a mistake, for example with a telephone number, and the parcel has been received by a third party whose number was entered by the consumer. In the latter case, the mistake is the responsibility of the consumer. The shipping costs of the goods are not refundable (if there is a shipping charge for the order, this is borne by the Buyer, as well as the cost of returning the goods).

The money for the returned goods shall be credited to the Buyer’s bank account as soon as possible, but not later than 10 working days after the goods are returned to the Seller.

For information

The shelf life and safe use of cosmetic products is regulated by the Cosmetics Regulation 1223/2009/EC.

For cosmetic products with a shelf life of more than 30 months, the open jar symbol on the product indicates the safe use period after opening the packaging (usually 6M or 12M). Cosmetic products with a shelf life after manufacture of less than 30 months will have a use-by date on the product.

The images accompanying the products are for illustrative purposes only.

Please note that, depending on the tones and brightness of the display, the cosmetic product shades displayed in the online shop may differ from the actual shades. Larger products in product photos may appear the same size as smaller products. This is due to zooming in on small products, i.e. increasing the scale of the photo image.

The term “eco-friendly product” is not legally regulated or protected. As a result, the perception of natural products by consumers, producers and retailers may also vary. Organic food products, including vegan, gluten-free and lactose-free products, are labelled as such in the Life Force online shop.
