Conditions of sale

1. GENERAL CONDITIONS

  1. The Terms and Conditions of Sale shall apply to the rights and obligations arising between the customers of the ecocenter.ee online shop (hereinafter referred to as the Customer) and Ecocenter OÜ (hereinafter referred to as ecocenter.ee) when purchasing goods.
  2. When registering as a user of Ecocenter.ee and/or purchasing products, the terms and conditions of this Agreement and the rights and obligations arising from the legislation of the Republic of Estonia shall apply.
  3. Ecocenter.ee reserves the right to make changes to the terms and conditions of sale and to the sale prices. These changes will be reflected on the ecocenter.ee website.

2. ENTRY INTO FORCE OF THE SALES CONTRACT

  1. Ecocenter.ee sells and the Customer buys the products offered in the e-shop.
  2. The sales contract between Ecocenter.ee and the Customer enters into force from the date of receipt of the amount due according to the order confirmation to the current account of Ecocenter OÜ.
  3. By placing an order and making payment in the Ecocenter.ee online shop, the Customer confirms that he/she has read and agrees to the terms and conditions of sale.

3. PRICES

  1. All prices in the ecocenter.ee online shop are in Euro and include VAT at 20% until 2024, when the VAT rate will increase to 22%.
  2. Ecocenter.ee reserves the right to adjust prices. If the Customer submits an order before the price changes come into effect, the Customer will be charged the price that was shown on the invoice at the time the order was placed. The Customer shall not be entitled to claim compensation for the price difference.

4. PLACING AN ORDER AND PAYING FOR THE GOODS

  1. When paying for the order, the Customer can choose the payment method that suits them: Swedbank, SEB, LHV, Luminor, COOP, Citadele, Revolut and N26. The customer pays 100% of the order amount to confirm the order.
  2. The sales contract is deemed to be concluded and the order will be executed as soon as the Customer has paid 100% of the order confirmation.

5. DELIVERY TO

  1. After the sales contract has entered into force (payment of the invoice by the Customer), ecocenter.ee will bundle the order and hand it over to our logistics partners.
  2. The delivery deadlines indicated on the Ecocenter.ee website are valid from the moment of payment of the invoice.
  3. The Customer is obliged to inform ecocenter.ee of any change in the destination or the agreed time immediately before the delivery of the goods.
  4. The accuracy and correctness of the information provided in the order is crucial for avoiding delays and misunderstandings in the delivery of the goods. Ecocenter.ee shall not be liable for any delay in delivery of the Products and any misunderstandings that may arise if the delay or misunderstanding is due to the inaccuracy of the information provided by the Customer when placing the order.
  5. Shipments damaged in transit where the Products, but not the Product packaging, have been damaged will be replaced for the Customer. In the event that replacement proves impossible, we will offer compensation for the cost of the damaged goods.

6. RIGHT OF RETURN

  1. According to section 56(1) of the LOA, the customer has the right to withdraw from the contract within 14 days of receipt of the goods.
  2. Returned goods must be unused, undamaged and in their original packaging.
  3. The return of the goods is at the expense of the customer, unless the reason for the return is non-conformity with the order or defective goods.
  4. In order to return the goods, a free-form return request must be submitted by e-mail to info@ecocenter.ee within 14 days of receipt of the goods. The return request must include the name of the Customer, the name of the product and the invoice or order number.
  5. The Customer will be refunded the money for the returned goods immediately, but not later than 14 days after the receipt of the cancellation. In addition to the cost of the returned goods, the costs of delivery shall also be refunded.

7. COMPLAINTS PROCEDURE

  1. In the event of a defect in the Product, the Customer undertakes to notify ecocenter.ee of the problem by sending an e-mail to info@ecocenter.ee and providing the following information: name, contact details and the product defect. The corresponding declaration must be sent no later than two months after the defect has been discovered.
  2. Ecocenter.ee is not responsible for:
  • For damage to the product caused by the customer’s fault or negligence.
  • Defects resulting from improper use of the product.
  • For natural physical wear and tear of the product under normal use.

8. LIABILITY AND FORCE MAJEURE

  1. Ecocenter.ee shall be liable to the Customer and the Customer shall be liable to Ecocenter.ee for any damage caused to the other party by breach of these Terms and Conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
  2. Ecocenter.ee shall not be liable for any damage caused to the Customer or for any delay in the delivery of the product if the damage or delay in the delivery of the product is due to a circumstance that Ecocenter.ee could not influence or foresee.

9. PRIVACY

  1. By using the Ecocenter.ee website, the Customer gives its express and informed consent to ecocenter.ee to process its personal data.
  2. Ecocenter.ee will use the information provided by the Customer only for the purpose of fulfilling the Customer’s purchase order and will not disclose it to any third parties.

10. OTHER CONDITIONS

  1. Any disagreement or dispute arising out of these Terms and Conditions shall be resolved by the parties, in particular by negotiation. In the event that disputes arising from the Contract cannot be settled by negotiation between the parties, the Customer shall have the right to seek redress before the Consumer Protection Board or the Court of Justice. Ecocenter.ee shall have the right to take legal action to defend its rights.

Processing of personal data

The controller of personal data of ecocenter.ee e-shop is Ecocenter OÜ, registration code 16212789, address Kiige 1-2, Pärnu 80010 Pärnumaa, phone 5348 3678 and e-mail info@ecocenter.ee (hereinafter referred to as the “merchant”).

What personal data is processed

  • name;
  • contact information, such as phone number and e-mail address;
  • payer and delivery address;
  • the cost of goods and services and payment details (purchase history);
  • customer support details;
  • other information related to customer surveys and/or offers.

Purposes for which personal data is processed

  • Processing of personal data for the purpose of performing a contract with a customer. Processing of personal data for the performance of a legal obligation (e.g. accounting and consumer dispute resolution).
  • Personal data is used for the management of customer orders and the delivery of goods.
  • Purchase history data (date of purchase, goods, quantity, customer details) is used to compile an overview of goods and services purchased and to analyse customer preferences.
  • The bank account number is used to return payments to the customer.
  • Personal data, such as e-mail address, telephone number, customer name, are processed in order to resolve issues related to the provision of goods and services (customer support).
  • The e-shop user’s IP address or other network identifiers are processed for the purpose of providing the e-shop as an information society service and for the purpose of web usage statistics.

Transfers of personal data to processors

The Merchant shall keep confidential the personal data of the Customer that have become known to it in the course of registration and use of the User Account and shall disclose them to third parties only with the Customer’s consent, unless the obligation or right to disclose the data is required by law. The user of the e-shop agrees that the trader has the right to process his/her personal data in order to provide the customer with the appropriate services, including the transmission of the customer’s data to persons connected with the provision of the service by the trader to the customer. Information technology service providers – Personal data is transferred to information technology service providers because it is necessary to ensure the functionality of the e-shop and to ensure data security.

Security and data access

Personal data is stored on Zone Media OÜ ( zone.ee ) servers.

The e-shop implements appropriate physical, organisational and IT security measures to protect personal data against accidental or unlawful destruction, loss, alteration or unauthorised access and disclosure.

Transfers of personal data to processors of the e-shop – The processing of personal data is based on contracts between the e-shop and the processors. The processors are obliged to ensure appropriate safeguards when processing personal data.

Accessing and correcting personal data

Withdrawal of consent

If the processing of personal data is based on the customer’s consent, the customer has the right to withdraw the consent in the e-shop account management.

Storage

When you close your e-shop customer account, your personal data will be deleted, unless such data need to be stored for accounting purposes or to resolve consumer disputes.

If a purchase is made as a guest in an online shop (without a user account), the personalised purchase history will be kept indefinitely.

In the case of disputes relating to payments and consumer disputes, personal data will be kept until the claim is settled or the limitation period expires (three years).

Personal data necessary for accounting purposes are kept for seven years.

Deletion

The personal data stored in the e-shop, including the user account, can be deleted in the e-shop account management.

You can request the deletion of other personal data by emailing info@ecocenter.ee.

Dispute resolution

Disputes relating to the processing of personal data will be resolved through customer support. The supervisory authority is the Estonian Data Protection Inspectorate(info@aki.ee).
